JUSTICE S.C.DAS Learned CGC, Mr. Bidyut Majumder for the appellant-petitioner submits that respondent No.4 has died and her legal heirs are already on record who have been arrayed as respondent No.1,2 and 3 and therefore, he prays for deleting the name of respondent No.4 from the array of respondents.

Prayer is allowed.

Registry is directed to delete the name of respondent No.4 from the array of the respondents.

This is a petition under Section 5 of the Limitation Act seeking condonation of delay of 598 days in filing connected LA. APP No.50 of 2014. Though there is a written objection filed on behalf of the respondents but today there is no representation on behalf of them for hearing of the matter. I have perused the petition seeking condonation as well as written objection. Considering the ground set forth in the petition seeking condonation of delay as well as the objection thereto raised by the respondents, I feel for fair end of justice, delay should be condoned and accordingly the period of delay in filing the connected appeal stands condoned, subject to condition that appellant-petitioner shall pay a cost of Rs.2000/- (Rs. two thousand) to the Library fund of the Bar Council of Tripura within two months from today.
