JUSTICE S.TALAPATRA This petition is filed under Section 482 of the Cr.P.C., for extension of time for depositing the fine money of Rs.50,000/- (Rupees fifty thousand), as was so directed to be deposited by the judgment and order dated 13.06.2014 delivered in CRL. REV. P. No.02 of 2011, else to suffer 3(three) months simple imprisonment.
Mr. D.C. Saha, learned counsel appearing for the petitioner submits that for serious distress, the petitioner could not deposit the said fine money but now he is ready to pay the said fine money in the trial court. But the period for depositing the fine money has elapsed. Having regard to the reasons so assigned in this petition, the petitioner is granted another 10 days time to deposit the entire fine money. In default, the petitioner shall invariably surrender before the trial court to suffer the default imprisonment as indicated in the said judgment and order dated 13.06.2014. If the petitioner does not so surrender in terms of this order, the stern coercive action shall be taken by the trial. With this observation and direction, this interlocutory application stands allowed and accordingly, disposed of.
