SAHA The instant application is filed under Section 389 of Cr.P.C for suspending the conviction and sentence dated 22.08.2015 passed by the learned Sessions Judge, Gomati District, Udaipur in S.T.38(GT/U)/2014 wherein the applicant was convicted for commission of offence under Section 498 A of the IPC and sentenced to suffer R.I. for three years and to pay a fine of Rs.10,000/- in default to suffer further S.I. for six months. Heard Mr. D.Sarkar, learned counsel appearing for the applicant as well as Mr. RC Debnath, learned Additional PP.

This Court has also perused the impugned judgment. According to this Court, it is a fit case where the sentence should be suspended.

Accordingly, it is ordered that the order of sentence dated 22.08.2015 shall remain suspended till disposal of the connected appeal. The applicant shall be released on bail on furnishing a bail bond of Rs.15,000/- with one surety of the like amount to the satisfaction of the learned trial Court.
