JUSTICE S.TALAPATRA For inadvertence, in the last line of paragraph-14 of the judgment and order dated 27.07.2015 in RSA No.85 of 2011 it has been typed as "But under no circumstance, the parties shall not be allowed to lead the fresh evidence, except what has been directed hereunder."

For insertion of the word 'not' in between 'shall' and 'be' wrongly the direction has become the opposite to what has been intended by this Court. As a result, this line shall be treated as deleted and substituted by the following line. "But under no circumstance, the parties shall be allowed to lead the fresh evidence, except in the manner what has been directed hereunder." The necessary correction be made in the judgment and order and as abundant caution this order shall form the part of the judgment and order dated 27.07.2015 delivered in RSA No.85 of 2011.

When this order has been passed under Section 152 of the CPC, both the counsel namely Mr. G. S. Bhattachrjee for the appellants and Mr. K. Nath for the respondent are present before this Court.
