SAHA The instant application is filed for passing an interim order staying all operations of the Circular/Order issued under No. F.T.GB/HO (P & A)/Promotion/Cir-47/15 dated 31.08.2015, issued by the Chairman, Tripura Gramin Bank, the respondent No. 2 herein, for promotion of the officer from scale-II to III.

Heard Mr. S. M. Chakraborty, learned senior counsel appearing for the applicants as well as Mr. K. Bhattacharji, learned counsel appearing for the respondents Bank. It appears from the record that on earlier occasion also one C.M Application being No. 192 of 2014 has been filed, wherein, this Court directed the respondent Nos. 1 and 2 to allow petitioners to appear in the examination for promotion from the post of Officers scale-II (M.M-II) to Officers scale-III(M.M-III) to be taken pursuant to the Circular No. TGB/HO/P&A/Promotion/Cir-19/2014 dated 27.02.2014 if the petitioners are eligible in terms of the recruitment rules, without prejudice to their contention raised in the writ petition being W.P. (C). No. 245 of 2011.

In the instant petition also, the petitioners are praying almost similar prayer. This Court has gone through the prayer of the petitioners in the instant petition. According to this Court, it would meet justice if the following order is passed that any promotion on the basis of Circular issued under No. F.T.GB/ HO (P & A) / Promotion / Cir-47/15 dated 31.08.2015 shall be subject to the result of the writ petition.
