Biswas, learned senior counsel assisted by Mr. P. Majumder, learned counsel appearing for the petitioners as well as Mr. A. Ghosh, learned PP appearing for the respondent No.1 and Mr. Samarjit Bhattacharjee, learned legal aid counsel appearing for the respondent No.2.

It has been stated in the Bar in unison that the matrimonial disputes have been amicably resolved except for the petition for granting decree of divorce by dissolving the marriage which is pending in the Court of the Principal Judge, Family Court, Silchar, District-Cachar being FC(Civil) Case No.181 of 2010.

But Mr. Biswas, learned senior counsel has submitted that from the order dated 20.02.2015, it would be apparent that the petitioner No.1 and the respondent No.2 filed a petition being Petition No.258/8 in FC (Civil) No.181 of 2010 for grant of divorce on mutual consent and to that effect a lump sum alimony of Rs.5,00,000/- (Rupees five lakh) has already been paid to the respondent No.2. Even her properties have been returned. It appears from the order dated 08.04.2015 delivered in GR 444 of 2010 by the Chief Judicial Magistrate, North Tripura, Dharmanagar that on the prayer of the State made under Section 321 of the Cr.P.C., the prosecution against the petitioners has already been withdrawn and they have been discharged from criminal liability. In view of the order dated 08.04.2015, this petition has become infructuous. Accordingly, this petition stands disposed of.
