Majumder, learned counsel appears for the petitioner as well as Mr. A. Ghosh, learned Public Prosecutor appearing for the respondent No.2 and Mr. A. Sengupta, learned counsel appearing for the respondent No.1. By the order dated 21.11.2014, this court permitted settlement of the dispute on payment of the amount as settled and also recorded that since the parties have sorted out the dispute on the basis of the compromise arrived at, the said compromise be accepted. The rest of the amount has been paid and Mr. A. Sengupta, learned counsel, who is present before the court alongwith Mr. Uma Sankar Das (the respondent No.1), has submitted that Mr. Uma Sankar Das has received the remaining part of the amount to his entire satisfaction. As such, the offence committed under Section 138 of the N.I. Act having been compounded, the petitioner is acquitted from the charge and his sureties are discharged from their liabilities.
Accordingly, this petition stands disposed of. The penal amount in terms of the direction of the apex court is waived in this case having regard to the earlier order dated 21.11.2014. Download Date: 8-05-2017 16:05 1/1
