SAHA The instant application is filed for staying the order of sentence dated 19.09.2015 passed by the learned Sessions Judge, North Tripura, Dharmanagar in Criminal Appeal No. 14 of 2014 whereby and where under the appeal was dismissed affirming the judgment and order of conviction and sentence dated 07.05.2015 passed by the learned Sub Divisional Judicial Magistrate, Dharmanagar, North Tripura in GR 311 of 2003 convicting the petitioner under Section 120B and sentenced to suffer S.I for 6 months and fine of Rs.2,000/- in default to suffer S.I for 15 days and also sentenced to suffer S.I for 6 months and fine of Rs. 2,000/- in default to suffer S.

I for 15 days for commission of offence punishable under Section 109 read with Section 409 of the IPC. Heard Mr. R. Dutta, learned counsel appearing for the applicant as well as Mr. RC Debnath, learned Additional Public Prosecutor appearing for the State. This court has perused the impugned judgment and also considered the submission of the learned counsel appearing for the parties.

According to this court it would be proper to suspend the sentence, as stated above passed by the learned SDJM, Dharmanagar, North Tripura affirmed by the learned appellate court. Accordingly, it is ordered.

The applicant shall be released on bail on furnishing a bail bond of Rs.10,000/- with one local surety to the satisfaction of the learned trial court. Download Date: 8-05-2017 16:05 1/1
