SAHA The instant application is filed by the accused petitioners Sri Samrat Debnath and Smt. Dipali Debnath under Section 438 of the Cr.P.C for granting them bail in the event of their arrest in connection with Santirbazaar police station case No. 2015/STB/043 under Section 498A of the IPC.

Heard learned counsel appearing for the parties. Mr. BN Majumder, learned counsel appearing for the accused petitioners while urging for bail would contend that the allegation made in the FIR is false and fabricated one and the same was lodged only to harass the accused petitioners. Mr. RC Debnath, learned Additional PP produced the case diary of the aforesaid police case.

On perusal of the case diary, this Court is of considered opinion that the available materials are not sufficient for arresting the accused petitioners and more so this is a case relating to an offence punishable under Section 498A of the IPC. Considering the entire facts and circumstances, it is directed that the accused petitioners namely Sri Samrat Debnath and Smt. Dipali Debnath shall be released on bail in the event of their arrest in connection with the aforesaid police case on furnishing a bail bond of Rs.20,000/- each with one surety each of the like amount to the satisfaction of the arresting authority and on further condition that they shall appear before the I.O of the case once in a fortnight till the investigation is completed.
