The petitioner should have filed an appeal under Section 378(4) of the Cr.P.C. against the order of acquittal as impugned herein. In view of above submission, this petition is disposed of as not pressed, but with liberty to the petitioner to file an appropriate appeal as indicated without further delay with ancillary other applications.
