THE HON'BLE MR. JUSTICE S. TALAPATRA 05.02.2018 Heard Mr. S. S. Debnath, learned counsel appearing for the claimantapplicant as well as Mr. H. Deb, learned ASGI appearing for the respondents.
By the common judgment and order dated 28.07.2015 this court modified the impugned judgment by fixing a different rate for some categories of land.
Mr. S.S. Debnath, learned counsel has submitted that in terms of the said judgment the appellant-respondents have deposited the awarded amount. Now this petition has been filed by the referring claimant-applicant for granting the leave to receive the said amount from the Registry.
Mr. H. Deb, learned ASGI has submitted that the appellant-respondents do not have any opposition if the money is disbursed to the claimant-applicant. There is no embargo for the claimant-applicant to receive the said amount as deposited by the appellant-respondents.
In view of that, this petition stands allowed and disposed of.
The Registry is directed to disburse the entire deposited amount to the claimant-applicant following the procedure.
