Case No :AB 0000128/2015 Party Name : MD. SALEK AHMED Vs THE STATE OF TRIPURA HONBLE THE CHIEF JUSTICE DEEPAK GUPTA This is an application for grant of anticipatory bail filed by the applicant, Md. Salek Ahmed in respect of FIR No.143 of 2011 registered with Police Station Dharmanagar under Sections 420/406/34 IPC.

The allegations against the applicant is that the applicant being the Director of Silver Stripe Marketing Ltd. had cheated the complainant and other persons out of huge amounts of money. The case of the applicant is that he had left the company much before the complaint was filed. Three of the other directors of the company have already been granted bail vide order dated 11.06.2015 passed in AB No.38 of 2015. This Court is not going into the merits of the case. The FIR was lodged in the year 2011 and even the police virtually made no attempt to arrest the applicant for almost 4(four) years. Pursuant to the orders passed by this Court the applicant is co-operating with the Investigating Agency.

In view of these developments, I am of the clear cut view that this is a fit case where anticipatory bail should be granted and accordingly, it is directed that in the event of his arrest, the applicant, Md. Salek Ahmed shall be enlarged on bail on his furnishing a bail bond in the sum of Rs.10,000/- (Rupees ten thousand) with one surety in the like amount to the satisfaction of the Arresting Officer subject to the following terms and conditions:- (i) That the applicant shall report to the police station, Dharmanagar on 17th October, 2015 at 10.30 am and on each date thereafter as ordered by a written notice by the Investigating Officer concerned.

(ii) The applicant is directed not to tamper with or in any manner influence the prosecution witnesses;

(iii) The applicant is further directed not to in any manner try to influence any of the prosecution witnesses;

(iv) The applicant is further directed not to cause any hindrance in the investigation; (v) In case the applicant is even remotely involved in any other case of violence or in trying to influence the prosecution evidence, the State shall be at liberty to approach this Court for cancellation of bail.

Application is disposed of.
