SAHA The instant application is filed for staying the execution of the impugned judgment and order dated 19.09.2015 passed by the learned Sessions Judge, North Tripura, Dharmanagar in Criminal Appeal no. 19 of 2014 wherein the appeal was dismissed affirming the judgment and order of conviction and sentence dated 07.05.2014 in case No. GR 311 of 2003 passed by the learned Sub Divisional Judicial Magistrate, Dharmanagar, North Tripura convicting and sentencing the petitioner under Section 120B of the IPC and sentenced to suffer SI for 6 months and fine of Rs.2,000/- in default to further SI for 15 days and also convicted him under Sections 109 of the IPC read with Section 409 of the IPC sentencing to suffer SI for 6 months and fine of Rs.2,000/- in default to further SI for 15 days and all the sentences shall run consecutively.

Heard learned counsel appearing for the parties and also perused the impugned judgment. According to this Court this is a fit case where the sentence should be suspended. Accordingly it is ordered.

The petitioner shall be released on bail on furnishing a bail bond of Rs.10,000/- with one surety of the like amount to the satisfaction of the learned trial Court. The Interim application is accordingly disposed of. Download Date: 8-05-2017 16:05 1/1
