Biswas for the applicant, learned counsel, Mr. K. Nath for the writ petitioner and learned Addl. G.A., Mrs. A.S. Lodh for the State respondents. By filing this petition, the applicant, Dilip Kumar Sarkar prayed for arraying him as a respondent in the writ case on the ground that on his application and evidence the certificate of notary of the writ petitioner was cancelled and so he is a necessary party for deciding the writ petition.

Learned counsel, Mr. Nath submits that the certificate of notary of the writ petitioner was cancelled at the instance of the State respondents and therefore the State respondents have been made party in the writ case and the present applicant has nothing to do with the action taken by the State respondents.

Learned Addl. G.A., Mrs. Lodh submits that the notary certificate of the writ petitioner was cancelled on the basis of the complaint and evidence adduced by the applicant Dilip Kumar Sarkar and so he may be added as respondent for fair adjudication of the writ petition.

Considering the submissions of learned counsel of the parties, I think the applicant, Dilip Kumar Sarkar is a proper party whose presence is required for disposal of the writ petition.

Accordingly, the CM Application is allowed. Dilip Kumar Sarkar, the applicant be added as respondent no.4 in the writ petition. The CM Application accordingly stands disposed of. Download Date: 8-05-2017 16:05 1/1
