SAHA The instant application is filed by the convict appellant-applicant for suspension of sentence passed in the judgment and order dated 07.05.2014 by the learned Sub-Divisional Judicial Magistrate, Dharmanagar, North Tripura, in Case No. G.R. 311 of 2003, wherein, the convict appellant-applicant was convicted under Sections 109 read with Section 409/120B of the IPC and sentenced to suffer SI for 6 months and to pay a fine of Rs. 2000/- in default to suffer SI for further 15 days for commission of offence under Section under Section 120B of the IPC and also to suffer SI for 6 months and to pay a fine of Rs. 2000/-, in default to suffer SI for further 15 days for commission of offence under Section 109 of the IPC. Both the sentences will run consecutively.

Heard Mr. S. Kar Bhowmik, learned counsel appearing for the appellant-applicant and Mr. A. Ghosh, learned P.P. appearing for the State respondent. This Court has gone through the impugned judgment and after going through the impugned judgment, this Court is of the considered opinion that it is a fit case where the order of sentence dated 07.05.2014 passed by the Sub-Divisional Judicial Magistrate, Dharmanagar, North Tripura, should be suspended.

Accordingly, it is ordered. The convict appellant-applicant shall be released on bail on furnishing a bail bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the learned Trial Court.

The Misc application is disposed of.
