No.137 of 2015 for the petitioner, namely Smt. Bina Chakraborty and A.B. No.139 of 2015 for the petitioner, namely Bhaba Ranjan Chakraborty are taken up together for the simple reason that all the petitioners seeking bail under Section 438 of the Cr.P.C. are implicated in the Belonia Women P.S. case No. 2015 WPS (S) 33 under Sections 498-A/307/354 of the I.P.C. Mr. Debnath, learned Addl. P.P. appearing for the State at the outset has submitted that even there are some materials against the petitioners but he would not oppose the prayer for pre-arrest bail, if they are enlarged on bail on certain conditions in the interest of the investigation.
The allegations against the petitioners, namely Smt. Bina Chakraborty and Sri Bhaba Ranjan Chakraborty are that the victim, namely Sushmita Chakraborty was married to the son of the petitioners. The petitioner of A.B. No.139 of 2015 entered in the room of the victim and forcibly laid her for some motive, but nothing happened for her resistance. Thereafter, the son of the petitioners moved to a rented house but there the son of the petitioners allegedly created pressure and also did not provide food or the essential materials. Even her husband did not take care of the child. Mr. Bhowmik, learned counsel appearing for the petitioners has submitted that from a reading of the written ejahar itself, it would appear that the arrays of the allegations are concocted with ill-motive to harass the petitioners. On the other hand, Mr. R.C.
Debnath, learned Addl. P.P. appearing for the State has reiterated that on certain conditions, the pre-arrest bail may be considered. Situated thus, it is directed that in the event of the arrest of the petitioners namely, Smt. Bina Chakraborty and Sri Bhaba Ranjan Chakraborty they shall be released on bail on furnishing a bail bond of Rs.20,000/- (Rupees Twenty thousand) each supported by 1(one) surety each of the like amount to the satisfaction of the arresting authority subject to the condition that they shall appear before the investigating officer once in a week for the next 2(two) months and they shall not induce any person seized of material inputs in order to dissuade him to reveal the truth.
That apart, they shall not leave their ordinary place of residence without prior intimation to the investigating officer as indicated in these applications for bail.
