Case No :BA 0000140/2015 Party Name : SRIMAL DAS PETITIONER ON BEHALF OF ACCD TAPASH DAS Vs STATE OF TRIPURA HONBLE THE CHIEF JUSTICE DEEPAK GUPTA This application for grant of bail has been filed by the applicant Sri Srimal Das on behalf of accused Sri Tapas Das in connection with a case arising out of FIR No.87 of 2015 registered with Amtali Police Station under Sections 302/120(B)/34 of Indian Penal Code (IPC).

The petitioner is accused of having committed offences punishable under Sections 302/120(B)/34 I.P.C. It is true that the accused is not named in the FIR but during interrogation, the main accused Liton Das named the accused petitioner. Whether the statement of Liton Das is admissible in evidence or not is not to be decided at the stage of grant of bail. The fact remains that accused Liton Das in his self-inculpatory statement has also clearly stated that he was accompanied by the present petitioner when the victim was murdered. The case is at the investigation stage. Further evidence has to be collected, Charge Sheet has still to be filed and it cannot be said with certainty that the petitioner is not involved in the crime and, therefore, I am not inclined to grant bail in this case. Bail petition is, accordingly, dismissed.
