SAHA The instant application is filed for suspending the order of sentence dated 26.08.2015 passed in ST 04(ST/U) of 2004 by the learned District and Sessions Judge, Gomati District, Udaipur wherein the petitioner was convicted under Section 417 of the IPC and sentenced to suffer RI for one year and to pay fine of Rs.35,000/-, i.d. to suffer SI for six months for commission of the aforesaid offence. Heard Mr. Deb, learned counsel for the applicant as well as Mr. Ghosh, learned PP for the State and also perused the impugned judgment. According to this Court, this is a fit case where the sentence should be suspended. Accordingly, it is ordered that the order of sentence dated 26.08.

2015 passed in ST 04(ST/U) of 2004 by the learned District and Sessions Judge, Gomati District, Udaipur shall remain suspended till disposal of the connected Criminal Appeal 30/2015. The applicant shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- with one surety of the like amount to the satisfaction of the learned trial court. The IA is disposed of.
