Case No :Crl.M.Appl. 0000237/2014 Party Name : SUDIP SARKAR Vs SANKARI SARKAR THE HONBLE MR. JUSTICE S.TALAPATRA Heard Mr. D. Datta, learned counsel appearing for the petitioner as well as Dr. H. K. Bhattacharjee, learned counsel appearing for the respondent. Having regard to the explanation provided in the petition, even though the Court is very reluctant to condone the delay but after scrutinising the grounds of challenge and having regard to the possibility of reconciliation, this Court is inclined to condone the delay of 1494 days as an exceptional case, overriding the objection of the respondent. Dr. Bhattacharjee, learned counsel for the respondent however has submitted that the grounds advanced by the petitioner are entirely inadequate for condoning the delay. Accordingly, this petition stands allowed condoning the delay in filing the criminal revision petition under Section 19(4) of the Family Courts Act and disposed of. Download Date: 8-05-2017 16:05 1/1
