Bhattacharjee, learned counsel appearing for the appellant petitioner as well as Mr. S. R. Deb, learned counsel appearing on instruction of Mr. R. C. Debnath, learned Addl. PP for the State.

This is a petition under Section 389 of the Cr.P.C. for suspending the judgment and order dated 18.03.2014 passed in ST 124 of 2009 by the Addl. Sessions Judge, Court No.2, West Tripura, Agartala convicting the appellant petitioner under Section 498(A) of the IPC and sentencing him to suffer two years RI with fine of Rs.5,000/- in default to suffer further RI for three months.

In view of the provisions of Section 389(3) of the Cr.P.C. this is a fit case where this Court may consider suspension of the sentence. Accordingly, the said sentence is suspended till disposal of the connected appeal being Crl. A.(J) No.49 of 2014 subject to furnishing the bail bond of Rs.10,000/- supported by one surety of the like amount to the satisfaction of the Addl. Sessions Judge, West Tripura, Agartala and subject to further condition that the petitioner shall also bind by furnishing a separate bond that if after disposal of the appeal any further action is taken by the State, he would appear and participate in the said proceeding.
