Case No :Crl.Petn. 0000078/2014 Party Name : RUPCHAND MANDAL Vs THE STATE OF TRIPURA & ANR HONBLE THE CHIEF JUSTICE DEEPAK GUPTA This petition under section 397 of the Code of Criminal Procedure (Cr.P.C.) is directed against the order dated 27-05-2014 passed by the learned Sessions Judge, West Tripura, Agartala whereby he dismissed the Criminal Revision No.4 of 2014 filed by the present petitioner and held that the application filed by the petitioner under section 311 of Cr.P.C. was not maintainable as the informant-petitioner had no right to file the said application.
This matter was listed yesterday when none had appeared for the petitioner. Today also none appears for the petitioner.
The petitioner who is the informant in the case has filed the application for permission to re-examine under section 311 of Cr.P.C. This application was not filed by the Public Prosecutor and both the Courts below are absolutely right in coming to the conclusion that such an application on behalf of the informant is not maintainable.
