Perused the office report dated August 10, 2021. It appears from the said report that the appeal has been re-numbered from S.A. 1496 of 1955 and the LCRs connected with the appeal were received as per endorsement dated March 14, 1956 but the said LCRs could not be traced out as on the date of the said report.

The second appeal is pending since 1956 but no steps have been taken by the appellants for hearing of the said appeal except filing of two copies of paperbook on January 27, 1959. The state of affairs indicates that the appellants have lost their interest to proceed with the present second appeal.

S.A. 1182 of 1956 is dismissed for default without any order as to costs.

Department is directed to trace out and send down the Lower Court Records to the concerned Court immediately.
