Report submitted by the State be kept with the record. Report reflects that the learned Additional District Judge, Chandannagar, Hooghly has fixed 10th June, 2024 for executing return of the warrant of arrest.
Having considered the fact that the present petitioners are the residents of Maharashtra and other districts, I direct that on or before 10th June, 2024 if the petitioners appear and surrender before the learned Additional Sessions Judge, Chandannagar, Hooghly in connection with Chandannagar Police Station Case No.170 of 2015 corresponding to SC 94 of 2017, then in that case if from the records the learned trial court finds that earlier the present petitioners were on bail, the learned trial court will allow the petitioners, namely, Amrutrao Ramarao Deshmukh, Sanjay Ramarao Deshmukh, Sunil Baburao Deshmukh, Pankaj Amrutrao Deshmukh, Hemantrao Ramarao Deshmukh and Lalita Amrutrao Deshmukh to continue on the same bail and bond with condition
to appear before the court on each every date so fixed. Learned Sessions Judge will recall the warrant of arrest against the petitioners who appear before the court immediately after their appearance or surrender.
In case the petitioners do not appear or surrender on or before 10th June 2024, learned trial court will, on the next working day, resort to harsher process of law by adhering to Section 82 of the Code of Criminal Procedure.
With the aforesaid observations, CRR 2 of 2024 is disposed of.
