The petitioner is aggrieved by the progress of the trial in connection with T.R. Case No. 12 of 2022 arising out of NCB Crime No. 10/NCB/KOL/2022.

Learned advocate appearing for the NCB submits that till date there has been no delay which can be attributed as the examination-in-chief of the first witness is over, but the case is being deferred for cross-examination at the instance of the accused.

Records reflect that six witnesses are to be examined. Accordingly, I direct that the learned trial court would fix a schedule consisting of three dates and fix such schedule once in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment be granted to any of the parties. As the NCB was the investigating agency, in case any witness belonging to the department of the Narcotics Control Bureau who has been cited as a witness at the relevant point of time by the prosecution, is absent on the date so fixed, the

learned trial court would communicate with the Zonal Director of Narcotics Control Bureau who would immediately take steps for ensuring the presence of the witness concerned.

Learned public prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the dates so fixed for examination of the witnesses.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 1 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
