The petitioner claims to have been a Part-time Safai Karmachari with 1/3rd scale of wages in Central Bank of India and was attached to the Central Metro Branch. The petitioner was proceeded with in a criminal case on diverse allegations. The petitioner was also discharged from his services on 8th August, 2015. The termination order was not challenged. Subsequently, the petitioner was acquitted from the criminal case for which he applied for being reinstated. The petitioner then filed a writ petition, being WP 23775 (W) of 2019 which was disposed of by an order dated 20th January, 2020 granting the petitioner liberty to approach the appropriate Tribunal since the petitioner fell in the category of
workman. The petitioner approached the Industrial Tribunal and his application was duly received. The petitioner has challenged two orders in this writ petition respectively dated 18th November, 2019 and 15th July, 2019. The said two orders were admittedly passed prior to the order dated 20th January, 2020. The two orders, therefor, cannot be challenged in this writ petition filed on 2nd January, 2024. The records reveal that the petitioner's application before the Industrial Tribunal has been admitted and is yet to be disposed of.
In the aforesaid facts and circumstances, the writ petition is dismissed.
However, dismissal of this writ petition will not stand in the way in the petitioner referring to the orders dated 18th November, 2019 and 15th July, 2019 before the Industrial Tribunal in his application pending before such Tribunal if otherwise entitled to in law.
