Kausik (Allowed) CRM (M) 137 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bhimpur Police Station Case No. 17 of 2025 dated 11.01.2025 under Sections 143(2)/61(2) of the BNS, 2023 and Section 14 of the Foreigners Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than a year and is an Auto Driver who has been implicated in connection with the instant case.

Learned advocate for the State submits that charges have been framed and 3 witnesses have already been examined.

I find from the records that 18 witnesses have been cited by the prosecution. I have also taken into account the statement of the victim before the learned Judicial Magistrate. Having considered the same, I am of the view that further

detention of the petitioner is unwarranted considering his culpability and complicity.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Arup Ray @ Roy shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned CJM, Nadia at Krishnanagar.

If on bail petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Nadia without the prior permission of the learned Trial Court.

Accordingly, CRM (M) 137 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
