There is a statement recorded under Section 161 of the Code of Criminal Procedure of the neighbour of the victim implicating the petitioner in the assault on the victim. The victim died.

Police filed charge-sheet, however, considering the materials in the case diary and the involvement of the petitioner therein as transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected. CRM (A) 1 of 2023 is dismissed.
