The writ petitioner is engaged in the business of transportation of coal from ECL to leasehold land, and thereafter to the retailer. Allegation is made that the Hirapur Police Station, unduly delay the inspection process and demand illegal gratification for the purpose of allowing trucks to pass after inspection.

Counsel for the State refers to instructions of the Deputy Commissioner of Police, Asansol Police Commissionerate, to the O.C., Hirapur Police Station, not to harass trucks passing through the area or to unduly delay clearance. The police may, however, carry out their regular duties of inspection, strictly as per rules.

It is made absolutely clear that in the event of any request for illegal gratification or undue delay in the release of the petitioner's trucks, a suitable complaint may be immediately made to the Deputy Commissioner of Police, as indicated above. The DCP shall launch immediate action.

The O.C., Hirapur Police Station is specifically directed to ensure strict compliance of the aforesaid order.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to cots.
