He submits, the circumstances are that respondent has died without leaving any legal representative. The suit was for money. His client was plaintiff and is before this Court as appellant but even if the appeal is admitted and ultimately the suit decreed, execution cannot be.

We appreciate the situation. The circumstances noted above militate against prosecution of the appeal for admission.
