Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated on the basis of statement of co-accused and the petitioner is in custody for more than eight months. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the case started on the alleged recovery of 18200 bottles of phensedyl from a Truck. Consequently the name of the petitioner surfaced and the petitioner was arrested from Nagaland and from his rented house in West Bengal, 3.3 grams of heroin was recovered. It is submitted that although initially chargesheet has been submitted, but further investigation of the case is in progress.
Having regard to the plea of the State that an interstate racket is in operation, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.
The application for bail, being CRM (NDPS) 31 of 2026, is, thus, dismissed.
