No.1 The complaint in the present case was lodged by opposite party no.2, the sister of the petitioner on June 14, 2025. Based on the said complaint, Beliaghata Police Station Case No.93 of 2025 was registered under Sections 126(2), 115(2), 351(2) of Bharatiya Nyaya Sanhita, 2023.

Upon completion of investigation, the investigating agency has also filed charge sheet. Challenging the said charge sheet the petitioner has come up before this Court by filing this present application.

Before this Court, however, the petitioner as well as opposite party no.2 jointly submit that the dispute between the parties has been amicably settled.

The parties have jointly filed a petition of compromise before this Court, being CRAN 1 of 2026.

The report submitted before this Court by the investigating agency also corroborates the aforesaid position.

Upon consideration of the materials on record, this Court is of the view that the dispute between the parties is essentially private in nature and that a valid compromise has already been arrived at between them. In such circumstances, the continuation of the criminal proceedings would amount to an abuse of the process of law. Having regard to the principles laid down by the Hon'ble Supreme Court reported at (2012) 10 SCC 303 (Gian Singh v. State of Punjab), this Court is inclined to exercise its inherent jurisdiction to quash the present proceedings in the interest of justice. Accordingly, G.R. Case No. 1235 of 2025 arising out of Beliaghata Police Station Case No. 93 of 2025 dated June 14, 2025 under Sections 126(2), 115(2), 351(2) of Bharatiya Nyaya Sanhita, 2023, presently pending before the Learned Additional Chief Judicial Magistrate, Sealdah, South 24 Parganas, stands quashed in terms of the compromise recorded in CRAN 1 of 2026.

Accordingly, CRR 34 of 2026 along with CRAN 1 of 2026 is thus disposed of.
