CIVIL APPELLATE JURISDICTION (Via Video Conference) SMA No. 48 of 1963 Nalini Ranjan Goswami -versus- Amiya Ranjan Mukherjee None appears on behalf of the appellant. The respondent is also not represented.

Perused the office report dated August 17, 2021. It appears from the said report that the lower Court records of the connected Misc. Appeal No. 63 of 1961 has been received by the department but in spite of repeated reminders the lower Court records of the connected Misc. Case being Misc. Case No. 4 of 1961 has not yet been received by the department.

The instant Second Miscellaneous Appeal is pending since 1963, no steps have been taken by the appellant to make the appeal ready for hearing which signifies that the appellant has lost his interest to proceed with the present appeal.

SMA 48 of 1963 is therefore dismissed without any order as to costs.

Interim order, if there be any, stands vacated. The lower Court records received by the department be sent down to the concerned Courts below immediately. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance of all requisite formalities.
