It appears from the said report that the Lower Court Records connected to the present Second Appeal was received and on examination found complete way back on February 20, 1970 and two copies of Paper Books were filed on August 08, 1975. The appeal was ready for hearing since then, but no steps were taken by the appellants to get the appeal heard and disposed of during this long period.

The appeal is pending since 1963. It is, therefore, apparent that the appellants have lost their interest in pursuing the present Second Appeal.

S.A. 976 of 1963 is, therefore, dismissed.

Department is directed to send down the Lower Court Records immediately.
