The petitioner seeks quashing of FIR being Jamalpur Police Station Case No.332/21 dated 9th December, 2021.

Learned counsel for the State has produced a report in the form of instructions issued by the Officer-inCharge, Jamalpur Police Station, Purba Bardhaman addressed to the learned State Advocate and the same is taken on record.

Counsel for the State submits that there is acrimonious land dispute between the petitioner and his brother, who is private respondent. In violation of orders of the Executive Magistrate, inter alia, under section 144 of the CrPC, the petitioner was trying to construct over a property and scuffled with the police. As a consequence thereafter, FIR was registered against the petitioner under section 188 of the IPC.

This Court sees no reason to entertain the prayers of the writ petitioner. The writ petition must fail and hereby dismissed.

There shall be no order as to costs.
