Petitioner is aggrieved by the fact and submits that he purchased a land and intended to construct a boundary wall which has been resisted/obstructed by the local persons. To that effect, complaint was lodged with the police authorities and it was also informed to the police authorities that the members of the petitioner's family were assaulted and injured. However, no steps have been taken by the police authorities.

Learned advocate for the State submits a report prepared by the Officer-in-Charge, Suti Police Station. It is claimed in the report that no complaint regarding assault has been received by the police authorities. However, there is a dispute between the

petitioner and other local inhabitants pursuant to which proceedings under Section 126 of the BNSS have been drawn against both the parties.

Having regard to the fact that the police authorities are yet to receive a complaint, I grant liberty to the petitioner to file a complaint before the local police authorities who would assess regarding the correctness of the same and take steps in accordance with law.

With the aforesaid observations, WPA 161 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
