1. Learned Counsel for the respondent files a receipt indicating that notice of pendency of the appeal has been served on the learned Advocate for the Appellant, which is kept on record.

2. It is submitted by learned Counsel for the parties that the impugned decree, against which the appeal has been preferred, has already been executed in due process of law.

3. Accordingly, learned Counsel for the respondent contends that the appeal has been rendered infructuous.

4. Learned Counsel appearing for the Appellant, on instruction, submits that the appellant does not

want to proceed further with the appeal.

Accordingly, FA 10 of 2024 with I.A. No. CAN 1 of 2024 are dismissed for non-prosecution without any order as to costs.
