Seen the office report dated August 24, 2021. This appeal is pending since 1965. The appeal was admitted on September 02, 1968. The Lower Court Records in connection with the present Second Appeal although has been received by the Department, but the same has not been examined. The appeal is also ready as regards service.

The appellants, during this long period did not take any step to get the appeal disposed of which indicates that the appellants have lost their interest to proceed with the present Second Appeal.

S.A. 1859 of 1965 is, therefore, dismissed for default.

There shall be no order for costs.

Department is directed to send down the Lower Court Records immediately to the concerned Court below after examining the same. (Biswajit Basu, J.)
