The writ application has been preferred praying for direction upon the respondents to and/or any one of them to disburse higher pension from the succeeding month along with accrued arrear after remittance of additional amount in terms of the judgment dated 14th Nov 2025 (WPA 15459/2025 batch) of this Hon'ble Court, as the Petitioner's right to higher pension has crystallized upon submission of valid Joint Option and employer's correction of Employer's Member Id.

Mr.

Prasad, learned counsel for the respondents/EPF authorities on filing a report, submits/admits that the petitioner herein is entitled to higher pension and the matter is being processed on urgent basis to disburse higher pension to the petitioner herein.

Mr. Prasad further submits that the total exercise shall be completed within 6 weeks from the date of this order.

On hearing the learned counsels for the parties and on perusal of the materials on record, it appears that the petitioner herein superannuated on 31.01.2020 and as such the petitioner was in service on 01.09.2014, the cut off date as provided in the judgment of the Supreme Court in The Employees Provident Fund Organization & Anr. ETC. vs Sunil Kumar B. & Ors. ETC., in Civil Appeal Nos....... (arising out of the SLP (C) Nos. 8658-8659 of 2019), decided on November 04, 2022.

In the present case, the petitioner's prayer for higher pension has not been rejected and it is admitted that the petitioner is entitled to higher pension.

Accordingly, the writ application is disposed of on the undertaking given by the P.F. authorities that the petitioner shall be granted higher pension within 6 weeks from the date of this order, on completion of necessary formalities.

Writ application stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
