Learned advocate for the petitioner submits that petitioner is in custody from 8th October, 2025. It has also been submitted that there was a relationship which turned sour, subsequent to which the present case has been initiated. Learned advocate for the State has produced the case diary.

I find from the statement under Section 183 of the BNSS of the Victim that, partially the submissions advanced on behalf of the accused has its foundational facts. Having considered that the prosecution has cited 21 witnesses in support of its case and there has been no progress for the last 3 and a half months since the charge sheet has already been submitted, I am of the view that without entering into the merits of the case, petitioner be released on bail at this stage.

As such, the prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely Ujjal Mondal @ Maida shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge (POCSO) Court, at Baruipur. If on bail, the petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas, South without the prior permission of the Learned Special Court. Accordingly, CRM (M) 50 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
