Mr. Debashis Sur Mr. Mrinmoy Chatterjee .....for the petitioner Ms. Piyali Sengupta Ms. Rupsha Chakraborty .....for the State According to learned counsel appearing for the parties, the concerned District Magistrate/respondent No. 2 could not proceed with the matter since the petitioner was absent on the last date of hearing namely 13th January, 2023.

Counsel for the petitioner submits that the petitioner was informed on 13th January, 2023 itself about the hearing which was scheduled to be held on that date.

It is also submitted on behalf of the State that the documents submitted by the petitioner were incomplete by reason of which the hearing could not take place. WPA 37 of 2023 is disposed of with a direction on the petitioner to submit complete documents in the form required under Section 14 of the SARFAESI Act, 2002 within a week from date. The concerned District

Magistrate/respondent No. 2 shall dispose of the application/affidavit within the period provided under section 14(1)(b) of the SARFAESI Act, 2022.
