Roy Chowdhury @ Ramendranath Roy Chowdhury From the note of the department filed on 12.07.2024, it appears that the administrative notices were issued upon the sole appellant and the respondent but the said notices were unserved, as the sole appellant expired on 13/02/2004 and the respondent expired on 06.01.2008.

Let the report of the Assistant Registrar dated 12.07.2024 along with the report of the SI, Entally PS, Kolkata dated 06.07.2024 annexing the death certificate of the aforesaid appellant as well as the respondent be kept on record.

Despite service of notice, none appeared for the either of the parties and no further steps have been taken for substitution.

Under such circumstances, the instant appeal gets abated and, accordingly, disposed of.

Copy of the order be communicated to the department as well as the learned trial court for due compliance.
