It appears from the submission made by the petitioner in Court that he is aggrieved by the reasoned order passed by the Kolkata Municipal Corporation vide Memo No.P/69(03)/VI/42(S)/20 dated 11th March, 2020. It appears from the averments made in the writ petition that the impugned order has not been challenged. Neither any prayer made in the writ petition praying for setting aside or cancelling the same. The petitioner seeks leave to file a supplementary affidavit.

In my opinion the prayer of the petitioner for filing supplementary affidavit cannot be acceded because neither averments nor the grounds nor the prayers made in the writ petition challenges the order impugned. Accordingly, the instant writ petition being WPA 33 of 2021 stands dismissed. However, the dismissal of the writ petition will not stand in the way of the petitioner from filing a fresh petition, on the self-same cause of action, upon better particulars.
