WPA No. 58 of 2024 Rubi Begam Vs.

1. Learned counsel for the petitioner contends that the petitioner is a tenant in respect of the property-in-question and sought for electricity connection, which has not yet been given by the CESC Limited.

2. Learned counsel for the CESC Limited contends that upon inspection the CESC Limited found that there is already an existing electricity connection at the premises where the connection is sought by the petitioner.

Accordingly, the CESC Limited apprehends splitting of load, which is not permitted by Regulation 14 of the West Bengal Electricity Regulatory Commission (Recovery of Expenditure for Providing New Connections)

Regulations, 2013. Hence, the connection could not be given to the petitioner.

3. Learned counsel for the CESC Limited also hands over a communication dated June 8, 2023, which was allegedly sent to the petitioner and the same is kept on record.

4. Learned counsel for the petitioner controverts the allegation of the CESC limited and argues that the petitioner seeks the connection for a shop room, which has no existing connection and after dark, the petitioner cannot run the said shop.

5. Since there is a factual dispute regarding the issue raised by the parties, the appropriate authority in deciding the same is the Grievance Redressal Officer (GRO).

6. Accordingly, WPA No. 58 of 2024 is disposed of by granting liberty to the petitioner to approach the concerned GRO with the relief as sought therein.

7. If so approached, the said GRO shall decide the same in accordance with law upon giving an opportunity of hearing to all interested parties as expeditiously as possible, positively within four weeks from the approach being made.

8. There will be no order as to costs.

9. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
