Heard the learned Advocates for the parties.

We have considered the materials on record. Petitioner was present at the spot where narcotics above commercial quantity i.e. 76 kgs. of ganja was recovered. Trial has substantially progressed and eight out of 12 witnesses have been examined.

Under such circumstances, we are of the opinion petitioner has not been able to make out a case for bail either on merits or on the ground of delay.

Accordingly, the prayer for bail of the petitioner is rejected.
