Petitioner is in custody for three years. He submits there is inordinate delay in trial. He prays for bail. Learned Advocate for the State opposes the prayer for bail. Learned Advocate submits the victim-housewife was murdered. She made a dying declaration before the doctor. Son of the victim also saw the incident. .

We have considered the materials on record. There are ample materials implicating the petitioner in the murder. We are informed trial has commenced and five witnesses have been examined.

Hence, we are not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.

We request the trial court to conclude the trial as expeditiously as possible preferably within one year from the

next date fixed for recording evidence without granting unnecessary adjournments to either of the parties. (Ajay Kumar Gupta,J.) (Joymalya Bagchi, J.)
