The petitioner submits that the land grabbers are trying to grab the property and an application for injunction has also been filed in connection with Misc. Case No.200 of 2023, which is yet to be disposed of.

The order dated December 16, 2023 passed in Misc. Case No.200 of 2023 by the learned Presidency Small Cause Court at Calcutta, does not reflect that any application has been filed for injunction. Rather, the misc. case under Order XXI Rules 98 to 101 of the Code of Civil Procedure was registered by the order impugned and the learned court directed service upon the opposite parties therein.

This Court does not find any reason to interfere with the order impugned.

The learned court shall proceed with the pending misc. case and the application, if any, filed in connection thereto, in

accordance with law, upon considering the urgency pleaded by the petitioner.

The revisional application is, thus, disposed of. There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
