Criminal Revisional Jurisdiction CRR 802 of 2013 In the matter of : Sri Somnath Chowdhury .....petitioner.

In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure.

The revisional application was preferred challenging order dated 28.12.2012 passed by the learned Judicial Magistrate, 5th Court, Hooghly in M. C. No. 44 of 2012.

I have perused the order passed by the learned Magistrate, which is the subject matter of challenge before this court. I find from the said order that the learned Magistrate on a preliminary opinion awarded interim maintenance of Rs.6,000/- per month to the wife and Rs.2000/- per month to the minor son of the present petitioner aggregating to a sum of Rs.8000/- per month to be paid from the date of the order. The petitioner being aggrieved challenged the said order before this court. Having regard to the reasons so assigned by the learned Magistrate while awarding the interim maintenance, I am of the opinion that no interference is called for as the same is a measure during the pendency of the main proceedings. Thus, the revisional application being CRR 802 of 2013 is dismissed.

All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
