VS GOPAL MAHATO After perusing the report filed by the concerned Department is apparent that the administrative notices, dispatched to the appellants and respondents, have come back undelivered without any reason being specified.

Since there is no allegation that the address contained in the cause title of the contempt application on the basis whereof, the administrative notice was sent by the Department, it has to be presumed that the service has been communicated but no one appears either in support of the appellants or respondents. The appeal appears to have become infructuous over the passage of time, as such, the parties are no more interested to proceed or oppose the appeal. The appeal along with connected application, if any, is dismissed.

Let the Trial Court Records, if any, be returned to the concerned Trial Court with a copy of this order.

It will be open to the appellant(s) to seek for return of the original certified copy upon completion of necessary formalities.
