Learned counsel for the petitioner submits that the petitioner owns a submersible pump and seeks electricity connection to operate the same.

However, such connection has not yet been given by the WBSEDCL.

Learned counsel for the WBSEDCL files a written instruction which is kept on record.

It is indicated that due to potato being cultivated in the nearby land where a pole has to be erected to give electricity connection to the petitioner, the connection could not be given to the petitioner. 5.

It is also indicated that the potato is being grown by the petitioner himself.

Learned counsel for the petitioner denies the allegations.

However, it is submitted by the petitioner that in the event it is found that a potato crop is preventing the access of the WBSEDCL for installing a pole to give such electricity connection, the same will be removed by the petitioner within a fortnight from date.

Accordingly, WPA 71 of 2024 is disposed of by directing the petitioner to ensure that the WBSEDCL gets free access to the location where an electricity pole has to be installed to give connection to the petitioner.

Such action shall be taken by the petitioner within a fortnight from date.

10. The WBSEDCL shall, after a fortnight, hold a fresh inspection upon prior notice to the petitioner for the purpose of ascertaining whether the said location is fit for installing the pole.

11. Upon the locale being found fit, the WBSEDCL shall undertake all steps for immediately installing such pole and giving the electricity connection to the petitioner, subject to the petitioner complying with all due formalities.

12. The entire exercise, it is expected, shall be concluded by the WBSEDCL within four weeks from the date of such inspection.

13. There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
