It appears from the said report that the Lower Court Records connected to the present Second Appeal was received and on examination found complete way back on October 10, 1077, but no steps have been taken by the appellants to file the Paper Book or to take steps for making the appeal ready for hearing.

The appeal is pending since 1965. It is, therefore, clear that the appellants have lost their interest to proceed with the appeal.

S.A. 1758 of 1965 is, therefore, dismissed.

Department is directed to send down the Lower Court Records immediately.
